These Terms of Service ("Terms") govern your use of Site Secure ("Service"), a platform for safety, timecard, document, certification, and workplace communication workflows operated by Pulse Community Agency. By accessing or using Site Secure, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not use the Service.
1. Acceptance of Terms
By clicking "Accept," creating an account, or using Site Secure in any way, you agree to comply with these Terms and all applicable laws and regulations. We reserve the right to update or modify these Terms at any time. Your continued use of the Service following notification of changes constitutes your acceptance of the modified Terms.
2. Description of Service
Site Secure is a multi-tenant Software-as-a-Service (SaaS) platform designed to help construction and field-service organizations manage worker records, site activity, safety workflows, and communication. The Service includes:
- Worker safety, training, and document tracking
- Digital toolbox talks (safety training sessions) with signatures
- Worker certification tracking and expiration alerts
- Timecard and punch in/out system with GPS verification
- Digital signatures and signature collection
- Document management and central repository
- In-app messaging and notifications
- Mobile application for workers (iOS/Android via Expo)
- Dashboard and reporting tools for organization admins
3. User Accounts and Responsibilities
To use Site Secure, you must create an account with accurate, complete, and current information. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Notifying us immediately of unauthorized access or use
- Ensuring you have the authority to use the account on behalf of your organization
- Complying with all applicable laws in your jurisdiction
You may not share your account credentials with unauthorized users or allow unauthorized access to the Service. Site Secure is not responsible for any loss or damage resulting from your failure to maintain account security.
4. Acceptable Use
You agree not to use Site Secure for any unlawful purpose or in any way that violates these Terms or applicable law. Prohibited conduct includes, but is not limited to:
- Accessing or attempting to access unauthorized areas of the Service
- Disrupting or interfering with the normal operation of Site Secure
- Uploading malware, viruses, or other harmful code
- Harassing, threatening, defaming, or abusing other users
- Impersonating any person or entity
- Reverse engineering, decompiling, or attempting to discover source code
- Removing or obscuring any proprietary notices or labels
- Using the Service to send spam, unsolicited messages, or phishing attempts
- Violating any applicable laws, regulations, or third-party rights
5. Intellectual Property Rights
Site Secure and all content within it (including but not limited to software, design, graphics, user interface, and documentation) are owned by Pulse Community Agency and protected by copyright, trademark, and other intellectual property laws. You retain ownership of any content you upload to Site Secure ("User Content"), but grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your User Content solely to provide the Service.
You may not reproduce, distribute, modify, or transmit any part of Site Secure without our prior written permission. All rights not expressly granted are reserved.
6. Data and Privacy
Your use of Site Secure is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review our Privacy Policy to understand our data handling practices, including what personal information we collect, how we use it, how long we retain it, and your rights regarding your data.
Site Secure processes sensitive worker data including certifications, safety records, and location information. You are responsible for ensuring you have all necessary consents and legal authority to provide this data to us and for complying with all applicable data protection laws in your jurisdiction.

Site Secure is an operational records tool only.
Site Secure is provided AS-IS to assist with safety, timecard, document, and communication workflows. The Service is NOT a substitute for professional safety guidance, legal advice, payroll advice, or your organization's own workplace procedures. You remain solely responsible for ensuring your organization follows applicable workplace, payroll, safety, privacy, and recordkeeping requirements in your jurisdiction.
Site Secure does not guarantee that your use of the Service will satisfy any applicable law, regulation, contract, or standard. You should consult qualified professionals for safety, payroll, privacy, legal, and operational requirements.
B. Service Disclaimer
Site Secure is provided on an "AS-IS" and "AS-AVAILABLE" basis without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
C. Limitation of Liability
To the maximum extent permitted by law, neither Pulse Community Agency nor its officers, directors, employees, or agents shall be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, even if advised of the possibility of such damages.
Our total liability to you for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
D. Safety and Incident Responsibility
Site Secure is a tool for documenting and tracking safety activities. We are not responsible for workplace injuries, safety incidents, payroll decisions, missed communications, or failure to follow workplace requirements. You assume responsibility for worker safety, timekeeping review, incident investigation, and remediation. Any reports or documentation in Site Secure should be reviewed by your organization before being used for payroll, disciplinary, legal, insurance, or safety decisions.
8. Termination
Either party may terminate your account or the Service at any time, for any reason, with written notice. Pulse Community Agency may terminate your account immediately if you materially breach these Terms or use the Service for unlawful purposes.
Upon termination, your right to use the Service ends immediately. You remain responsible for all charges incurred prior to termination. Within a reasonable timeframe (as specified in your service agreement), we will delete or anonymize your User Content in accordance with our Privacy Policy and applicable data retention laws.
9. Changes to Terms
We may update or modify these Terms at any time to reflect changes to the Service, our business practices, or applicable law. We will provide notice of material changes via email or by posting a notice on the Site Secure website or application. Your continued use of the Service after the effective date of modified Terms constitutes your acceptance of the changes.
10. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Arkansas, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Arkansas for resolution of any disputes arising from or relating to these Terms or the Service.
